Terms of Service

Please read these Terms carefully before using McKent, a United States healthcare jobs and hiring platform. They govern your access to and use of our platform and services. By using McKent, you agree to these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using the McKent platform (available at mckent.net and related McKent websites and online services), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.
These Terms form a binding legal agreement between you and McKent Staffing LLC ("McKent", "we", "us", or "our"), a Texas limited liability company. We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email and in-app notification where reasonably practicable. Continued use after changes take effect constitutes acceptance, except where applicable law requires additional consent.
2. Eligibility
You must be at least 16 years of age to create an account. By registering, you represent that:
• You have the legal capacity to enter into binding contracts in your jurisdiction • You are not barred from receiving services under applicable law • If registering on behalf of a company, you have the authority to bind that company to these Terms
We reserve the right to verify eligibility and to refuse or terminate accounts that do not meet these requirements.
3. The McKent Platform
McKent Staffing LLC operates a technology platform for United States healthcare job discovery and hiring workflows. Healthcare professionals may discover jobs, create profiles, submit applications, and communicate with employers. Employers may post jobs, review applications, search candidate profiles where permitted, and manage hiring workflows.
McKent provides a technology platform. McKent does not generally employ candidates listed on the platform. McKent is not the employer of candidates merely because they use McKent. McKent is not an employer of record, employment agency that makes hiring decisions, or staffing company assigning workers merely by operating this platform. McKent does not make final hiring decisions for employers.
Employment relationships, if any, are between the employer and the candidate. McKent does not guarantee employment, an interview, a candidate, a hire, match accuracy, job availability, employer or candidate identity, or licensing status unless a feature on the platform expressly states that McKent has verified that item.
4. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at austin@mckent.net if you suspect unauthorized access.
You may register as a Candidate (job seeker) or as an Employer. Certain features are only available to the relevant account type. You may not create accounts for others without their consent, or create multiple accounts to circumvent suspensions.
We may suspend or terminate access for violation of these Terms, fraud or abuse, legal requirements, or security risks, with or without prior notice depending on the circumstances.
5. Employer Terms
Employers are responsible for their job postings; salary and pay information; employment terms; hiring decisions; interview decisions; legal employment practices; required licenses and credentials for their roles; and compliance with applicable U.S. employment laws.
Job postings must accurately describe the role, responsibilities, and requirements; must not contain discriminatory language based on protected characteristics; must not be misleading, deceptive, or fraudulent; and must comply with applicable law. McKent does not provide employment-law advice.
Employers are responsible for complying with applicable federal, state, and local employment, labor, equal-opportunity, wage, licensing, and anti-discrimination laws.
By posting a job, you consent to receiving applications from candidates and agree to use candidate data solely for recruitment purposes related to that posting or other hiring activity the candidate has permitted. You may not sell, share, or repurpose candidate data for unrelated purposes.
McKent does not warrant the accuracy of employer-entered job information. Employers remain responsible for listing accuracy, including pay, credentials, location, and whether a role remains open.
6. Candidate Terms
Candidates are responsible for the accuracy of profile and resume information; licenses and credentials they provide; job applications; communications; and independently evaluating employers and jobs.
You must not misrepresent your qualifications, experience, identity, or authorization to work. Submitting an application constitutes permission for the relevant employer to view your profile, resume, and related application information.
Profile visibility. By default, your profile is visible to employers when you apply for a role. You may make your profile more broadly visible to employers or restrict it to apply-only via available privacy settings, where those settings are offered.
You retain ownership of your resume and profile content. By uploading it to McKent, you grant McKent a non-exclusive, royalty-free license to store, parse, display, and process it as needed to operate matching, search, applications, and related platform features, as described in our Privacy Policy.
7. AI Features
McKent may use artificial intelligence and automated processing to assist with candidate matching, resume parsing, resume or application scoring, ranking, job recommendations, job-description assistance, and similar tools. You acknowledge that:
• AI outputs are probabilistic and may contain errors or inaccuracies • AI match scores and recommendations are assistive tools, not definitive determinations of qualification or suitability • Employers remain responsible for hiring decisions and should not make final hiring decisions based solely on an AI-generated score without human review • McKent does not make legally significant employment decisions automatically • Informational tools such as career or resume suggestions do not constitute professional, legal, or career counseling
If you believe an AI-generated score has unfairly affected you, contact austin@mckent.net to request a review.
8. Fees and Subscriptions
Some candidate services may be free. Employers may purchase paid plans or services, including offerings described publicly as Employer Pro and Enterprise or custom services. Prices, features, and billing terms are described on the Pricing page or at checkout. These Terms do not restate specific plan prices.
Subscription and other billing terms shown at purchase apply. Except where required by law or expressly stated at purchase, fees are non-refundable.
9. Prohibited Uses
You may not use the platform to:
• Post false, misleading, or fraudulent job listings or profiles • Post discriminatory job listings • Impersonate any person or organization • Harvest, scrape, or systematically collect data from the platform without written permission • Use automated bots, crawlers, or scripts to interact with the platform except as McKent expressly allows • Attempt to gain unauthorized access to other accounts, systems, or data, or to bypass platform, security, or access controls • Upload malicious code, viruses, or files that could harm our systems or other users • Engage in harassment, hate speech, spam, or threatening behavior • Use candidate data for unlawful purposes or for purposes unrelated to legitimate hiring for which the data was provided • Use the platform for any illegal purpose
Violations may result in suspension or termination and, where appropriate, referral to law enforcement.
10. Intellectual Property and User Content
McKent Platform: All code, design, algorithms, trademarks, and content owned or licensed by McKent is our intellectual property. You may not copy, modify, distribute, sell, or reverse-engineer any part of the platform except as allowed by law.
Your Content: You retain ownership of the content you submit (including job postings, profile text, resumes, and messages). By posting content on McKent, you grant us a worldwide, non-exclusive, royalty-free license to host, process, display, reproduce, and transmit that content solely to operate and improve the service. This license geography does not mean McKent is a worldwide job marketplace.
Feedback: If you submit feedback, suggestions, or ideas about the platform, you agree that we may use them freely without compensation or attribution.
11. Messaging
McKent provides in-app messaging to facilitate communication between employers and candidates. You agree to use messaging for professional, recruitment-related communication and not for spam, harassment, or unrelated advertising.
We do not routinely monitor messages but reserve the right to review communications to investigate complaints, policy violations, security issues, or legal matters. Do not share sensitive personal information such as financial account details, government identification numbers, or passwords through messages.
12. Disclaimer of Warranties
TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the extent permitted by applicable law, McKent does not guarantee that the platform will be uninterrupted, error-free, or free of harmful components; does not warrant the accuracy or completeness of any job posting, candidate profile, license, credential, or AI-generated output; and does not endorse any employer or candidate. McKent is not responsible for hiring outcomes, employer or candidate conduct, or employment decisions.
Nothing in these Terms is intended to exclude or limit rights or remedies that cannot be excluded or limited under applicable consumer law.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, McKENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR DIRECT DAMAGES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LEGALLY BE LIMITED, INCLUDING LIABILITY FOR FRAUD OR WILLFUL MISCONDUCT WHERE SUCH LIMITATION IS PROHIBITED.
14. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold McKent, its officers, members, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
• Your use of the platform • Your violation of these Terms • Your violation of any applicable law or third-party rights • Any content you post or submit, including job postings and profile information
15. Termination and Suspension
You may close your account via account settings or by emailing austin@mckent.net. McKent may suspend or terminate access for violation of these Terms, fraud or abuse, legal requirements, or security risks.
Upon termination, access to the platform ceases; we will handle personal information as described in our Privacy Policy and applicable law; outstanding fees remain payable; and provisions that by their nature should survive (including intellectual property, disclaimers, indemnity, limitation of liability, and governing law) continue to apply.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
Except where prohibited by applicable law, exclusive venue for disputes arising out of or relating to these Terms is the state or federal courts located in Travis County, Texas, and you and McKent consent to personal jurisdiction there.
If you are a consumer and applicable mandatory consumer-protection law gives you the right to bring a claim in another court, that right is not waived by this section.
These Terms do not require arbitration and do not appoint an arbitration provider. Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.
You may contact austin@mckent.net to try to resolve a dispute informally. That invitation does not limit any right to seek relief in court.
17. General
Entire Agreement: These Terms, together with the Privacy Policy and any specific service terms presented at purchase, constitute the entire agreement between you and McKent regarding the platform.
Severability: If any provision is found unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will continue in force.
Waiver: Failure to enforce any provision does not constitute a waiver of that right.
Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign ours in connection with a merger, acquisition, or sale of assets.
